====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 25-01-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner, in the present case, is seeking regular bail in connection with Sadar P.S. Case No. 255 of 2020 registered for the offences under Sections 400/412 of the I.P.C. and Sections 25(1-b) a, 26, 35 of the Arms Act.
Learned counsel for the petitioner submits that as per the First Information Report the informant is the Station House Officer of Sadar Police Station got secret information that gang of Appu Thakur has kept looted cash and arms in the house of Lokesh Kumar (petitioner). The informant raided the given place and apprehended this petitioner and recovered cash of Rs. 2,01,500 and two loaded country made pistol and two empty magazines.
Learned counsel for the petitioner submits that the petitioner is innocent and he has committed no offence and has
Patna High Court CR. MISC. No.30539 of 2020(5) dt.25-01-2021 2/2 falsely been implicated in this case by the police showing the alleged recovery from his house. It is submitted that the petitioner has got no criminal antecedent and he is in custody since 15.05.2020 without there being any cogent material against him.
Learned A.P.P. for the State is present and has opposed the prayer for regular bail of the petitioner.
Having regard to the facts and circumstances of the case wherein this Court has noticed from the materials on the record that there are recovery of looted money and several firearms and ammunitions have been recovered from the house of the petitioner at his instance, in the nature of the seriousness of the crime and the materials on the record, this Court is not inclined to grant privilege of regular bail to the petitioner. Prayer for bail of the petitioner is refused.
Let the trial be expedited.
