This application for anticipatory bail arises out of Kharagpur P.S. Case No. 437 of 2019 for the offence punishable under Sections 147, 148, 149, 341, 323, 427, 307, 452, 504, 506 of the Indian Penal Code and Sections 25(1-b)a/26(i)/27 of Arms Act.

Learned counsel appearing on behalf of the petitioner appears to be correct in his submission that the others co-accused persons, having similar allegation, have been granted anticipatory by this Court by order dated 06.03.2020 passed in Cr. Misc. No. 15848 of 2020.

On perusal of the order of this Court dated 06.03.2020, passed in Cr. Misc. No. 15848 of 2020 and the First

Patna High Court CR. MISC. No.30814 of 2020(2) dt.08-01-2021 2/2 Information Report, I do not find any distinguishing feature for taking a different view in case of the petitioners. This application is accordingly allowed.

Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Munger, in Kharagpur P.S. Case No. 437 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
