2. This Interlocutory Application has been filed for substituting the legal heirs of the sole petitioner who is said to
2/4 have died on 23.07.2016 during the pendency of the present writ application.
3. The details of the legal heirs have been given in paragraph-3 of this application.
4. Considering the formal nature of prayer made in this Interlocutory Application, for the reasons as stated therein, this Interlocutory Application is allowed and the name of the sole petitioner is directed to be deleted/expunged and in his place the legal heirs who have been named in paragraph-3 of the application is directed to be impleaded/substituted.
5. The Interlocutory Application is allowed and the Office is directed to make necessary changes in the Cause Title of the case.
Civil Writ Jurisdiction Case No.15509 of 2013 Learned counsel for the petitioners submits that he is prepared to file a representation before the Principal Secretary, Panchayati Raj Department, Government Of Bihar, Patna (respondent no. 7) for redressal of their grievance and prays that an appropriate direction be issued to the respondent no. 7 to dispose of the representation of the petitioners on merits after giving an opportunity of hearing to the
3/4 petitioners.
2. To the aforesaid prayer being made by learned counsel for the petitioners, the learned counsel for the Respondent-State does not have any objection.
3. Considering the limited nature of prayer being made by the substituted petitioners, the present writ application is disposed of granting liberty to the petitioners to file a representation before the Principal Secretary, Panchayati Raj Department, Government Of Bihar, Patna (respondent no.
7) within one month from the date of passing of this order and if such a representation is filed, the Principal Secretary, Panchayati Raj Department, Government Of Bihar, Patna (respondent no. 7) shall dispose of the same on merit after giving an opportunity of hearing to the petitioners. Needless to emphasize that the final order which shall be passed by the respondent no. 7 i.e., the Principal Secretary, Panchayati Raj Department, Government Of Bihar, Patna should be a reasoned and speaking order. The entire exercise must be completed by respondent no. 7 within six months from the date of filing of the representation.
4. With the aforesaid observation and direction, the present writ application is disposed of with the liberty
