The petitioner apprehends his arrest in connection with Taraiya P.S. Case No. 223 of 2018 registered under Sections 272, 273, 188 of the Indian Penal Code and sections 30, 30(a), 38 and 41 of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further he submits that petitioner is neither the owner of the alleged vehicle nor Driver or Khalasi in which liquor has been recovered. Petitioner has no criminal antecedent.

Having considered the facts and circumstances of the

Patna High Court CR. MISC. No.41283 of 2021(2) dt.02-03-2022 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the 2nd Additional Sessions Judgecum-Special Judge, Excise, Saran in connection with Taraiya P.S. Case No. 223 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
