The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act.

There is recovery of country made liquors from the houses of the petitioners.

It is submitted by learned counsel for the petitioners that petitioners were not apprehended from

Patna High Court CR. MISC. No.31227 of 2022(2) dt.16-09-2022 2/2 the spot. Nothing has been recovered from the conscious possession of the petitioners. A statement has been made in para 3 of the petition that petitioners have no criminal antecedents.

Considering the fact that petitioners are owners of the houses from where illicit liquor has been recovered, this Court is not inclined to grant privilege of anticipatory bail to the petitioners.

The petitioners are directed to surrender before learned Court below and pray for regular bail. The learned Court below may consider the prayer for regular bail of the petitioners, keeping in view the facts mentioned above and without being prejudiced by the order of this Court.

With the aforesaid observations/directions, the petition stands disposed off.
