The petitioners apprehend their arrest in a case registered for the offence under Section 420/34 & other allied sections of the Indian Penal Code and Section 63 of the Copy Rights Act.

As per the prosecution case, all the F.I.R. named accused persons including these petitioners were selling fake product of Lakme brand.

It is submitted on behalf of petitioners that petitioners have been made accused only on suspicion because the shop of the petitioners is situated near Manihari Store, where raid was

Patna High Court CR. MISC. No.31946 of 2022(2) dt.26-09-2022 2/2 conducted. No incriminating article has been recovered from the possession of these petitioners. Similarly situated co-accused Brijesh Prasad Gupta and Zubair Ahmad have already been granted anticipatory bail by this Court, vide order dated 16.08.2022 in Cr.Misc. No. 12672/2022 and order dated 22.08.2022 in Cr.Misc. No. 13169/2022 respectively. Petitioners have got clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah (Town) P.S. Case No. 617 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
