The petitioner seeks bail in Nautan P.S. Case No. 252 of 2019, registered for the offence under Sections 363, 511, 354(B), 34 of the Indian Penal Code.

As per the F.I.R., this petitioner alongwith other coaccused persons abducted the daughter of the informant on 26.06.2021, however; after some chase, they left the daughter of the informant and fled away.

It is submitted on behalf of petitioner that no such occurrence, as alleged in the F.I.R., has taken place and only due to village politics, petitioner has been made accused in this case. Similarly situated other three accused persons have already been granted bail by this Court, vide order dated 09.12.2020 passed in Cr.Misc. No. 32599 of 2020. Petitioner has got clean antecedent and he is in custody since 05.01.2021.

Patna High Court CR. MISC. No.41427 of 2021(2) dt.16-12-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Nautan P.S.
