19-07-2024 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.
2. Petitioner seeks bail in a case registered for the offence under Sections 302/201/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The prosecution case, in short, is that on the alleged date and time of occurrence, the son of informant had gone to attend the call of nature, but he did not return. During course of search, one Ramesh Paswan told the informant that some persons, who were standing in north direction, have taken away the son of informant. Thereafter, in the next morning, the informant saw that his son was lying dead in the field of one Nilanand Yadav, having gun shot injury.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Name of the petitioner
Patna High Court CR. MISC. No.35887 of 2024(2) dt.19-07-2024 2/2 transpired during course of investigation. It is the specific case of the informant that F.I.R. named accused persons have killed his son. Petitioner is in custody since 19.02.2024. Similarly situated co-accused Nunu Lal Yadav has already been granted bail by this Court, vide order dated 05.06.2020 passed in Cr.Misc. No. 18783 of 2020.
5. However, learned A.P.P. for the State vehemently opposes the prayer for bail of petitioner.
6. Considering the aforesaid facts and circumstances, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Araria/concerned court in connection with Sessions Trial No. 143 of 2024, arising out of Fulkaha P.S. Case No. 48 of 2014.
