Mr. Ajay Kumar Jha, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 22-11-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 354, 324, 325, 307, 379, 504 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that she threatened that she will complain to the Electricity Department regarding theft of electricity being committed by the accused persons on which Sikandar Rai assaulted by tengari causing injury on her head, further petitioner, Sunil along with women accused assaulted by lathi causing fracture of her waist.

No.31947 of 2022(2) dt.22-11-2022 2/2 Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, he is son-in-law of Sikandar Rai, it is next submitted that allegation of assault with respect to the petitioner is general and omnibus in nature and the injury report also records with respect to injury inflicted on head of the informant which was not caused by the petitioner.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Runnisaidpur P.S. Case No. 168 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
