This application for grant of regular bail arises out of Barh P.S. Case No. 492 of 2019, disclosing offences punishable under Section 394 of the Indian Penal Code.

According to the prosecution's case, some unknown miscreants after having stopped the informant on a National Highway, snatched bag containing cash of Rs. 1,00000/- and samsung mobile phone, at the point of pistol. After having committed the offence, they allegedly opened indiscriminate firing and fled away from the place of occurrence. The petitioner's name surfaced during the course of investigation. It appears from the case diary, which is available on record that one Amit Kumar was apprehended by the police,

Patna High Court CR. MISC. No.31649 of 2020(4) dt.05-03-2021 2/2 who confessed his involvement in the commission of the offence. It does not appear from the case diary that any specific role of the petitioner has emerged during the course of investigation. Further, said Amit Kumar has been allowed regular bail by this Court by an order dated 25.08.2020 passed in Cr. Misc. No. 22453 of 2020.

Considering the above, this application is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateI, Barh, Patna in Barh P.S. Case No. 492 of 2019.
