The petitioner has renewed his prayer for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code.

As per the prosecution case, the petitioner is said to have given a khanti blow on the head of the husband of the informant leading to serious injuries.

It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 28.7.2021 (Annexure-1) passed in Cr. Misc. no.6732 of 2021. He has been falsely implicated in the case. He is in custody since 9.10.2020 and has no criminal antecedent. Inspite of the charge having been framed, no witness has been examined on behalf of the prosecution in the last more than five

Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner, charge having been framed in the case on 8.3.2022 together with the petitioner having remained in custody since 9.10.2020, the Court directs the petitioner to be enlarged on bail in connection with Sessions Trial no.106 of 2022 (arising out of Raniganj P.S. Case no.97 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Araria.
