2. The petitioner is apprehending arrest in connection with Fulkaha P.S. Case No. 91 of 2021, dated 17.06.2021, lodged under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution, total recovery of 44.700 litres of illicit wine has been made, which is the subject matter of the present case.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel for the petitioner submits that nothing has been recovered from conscious possession of the petitioner. Further submitted that his name has come in the present case by virtue of being the owner

5. Learned APP for the State opposes the prayer for anticipatory bail of the petitioner submitting that the petitioner has got one criminal antecedent of similar nature and the recovery has been made from his motorcycle.

6. In the present facts and circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is hereby rejected.
