2. The petitioner seeks bail in connection with Phenhara P.S. Case No. 183 of 2024 / G.R. Case No. 7197 of 2024 for the offence under Sections 126(2), 115(2), 118(1), 109, 75, 303(2), 352, 351(2), 3(5) of the BNS and later Section 103(2)(1) was also added.

3. As per the prosecution case, the deceased is said to have been killed by the accused persons.

4. The petitioner is not the assailant of the deceased and he said to be the member of the mob. The petitioner's age is 72 years and he is in custody since 16.12.2024.

5. Considering the aforesaid facts, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Motihari, East Champaran/concerned Court below in connection with Phenhara P.S. Case No. 183 of 2024/G.R. Case No. 7197 of 2024.

7. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
