2. The petitioner is in custody in connection with Araria (Bairgachhi) P.S. Case No. 1115 of 2022 for the offence punishable under sections 304(B)/201/34 of the Indian Penal Code and under Section 3⁄4 of the D.P. Act lodged on 16.12.2022 by the informant, Md. Prawez.

3. As per the prosecution story, the informant alleged that his daughter was married to the petitioner but was tortured for dowry and on 16.02.2022, an information came about her killing. This led to the FIR.

4. Learned counsel for the petitioner submits that only on suspicion, he has been made accused and there is no eye witness to the occurrence.

5. Learned APP on the other hand opposes the prayer for

Patna High Court CR. MISC. No.30494 of 2025(4) dt.06-08-2025 2/2 bail submitting that the matter is of the year 2022, the petitioner came into the judicial custody only in the year 2025 and the post mortem report records the death due to throttling.

6. Considering the submissions of the parties as also the fact which has been recorded in the post mortem report, no relief can be granted to the petitioner.

7. The bail application shall stands rejected.

8. Since the matter is of the year 2022, the trial court is expected to take the trial to its logical conclusion at an earliest. (Rajiv Roy, J) Raj Ranjan/- U T
