The petitioner is in custody in connection with Daudpur P.S. Case No. 147 of 2020 for the offences under Sections 30(a) of the Bihar Prohibition & Excise Act.
Learned counsel appearing on behalf of the petitioner would submits that petitioner has no criminal antecedent and in the instant case, nothing was recovered from the conscious possession of the petitioner.
The petitioner is in custody since 30.06.2020.
Patna High Court CR. MISC. No.30978 of 2020(2) dt.06-01-2021 2/2 This Court is not inclined to grant bail to the petitioner for the present.
However, considering the fact that petitioner has no criminal antecedent and only on the basis of suspicion, the petitioner has been implicated in this case, learned Court below is directed to release the petitioner on bail after completion of nine months of custody and on his furnishing bail bonds of Rs. 50,000/- (Rupees Fifty Thousands) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Saran at Chapra in connection with Daudpur P.S. Case No. 147 of 2020.
With the aforesaid observations and directions, the application stands disposed off.
