====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-05-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Saharsa Sadar P. S. Case No. 515 of 2024 registered for the offences punishable under Sections 341, 323, 302, 328 and 120(B) of the Indian Penal Code.
3. As per F.I.R., informant suspects that this petitioner, who is wife of informant, along with co-accused Kuldeep Yadav i.e. brother-in-law of the informant killed the sister of informant by administering poison as this petitioner and the brother-in-law of informant were having illicit relationship.
4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. During investigation, no material has come up on record to show the petitioner administered poison and killed the deceased. As a matter of fact, the sister of informant consumed pesticides
Patna High Court CR. MISC. No.31049 of 2026(2) dt.14-05-2026 2/2 and died as she was a short tempered lady and easily got annoyed and agitated. Petitioner has been made accused in this case merely on the ground that she was having illicit relation with the husband of deceased, namely, Kuldeep Yadav who has already been granted regular bail by co-ordinate Bench of this Court vide order dated 29.01.2025 passed in Cr. Misc. No. 78478 of 2024. F.I.R. has been lodged after inordinate delay of five days which itself raises doubt over veracity of the prosecution case. Petitioner is lady, claims clean antecedent and is in custody since 07.01.2026.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation, clean antecedent and period of custody, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.
