2. The petitioner has prayed for bail in connection with Baijnathpur P.S. Case No. 145 of 2024 registered for the offence punishable under Sections 126(2), 115(2), 118(1), 303(2), 109, 351(2), 351(3) r/w 3(5) of B.N.S.
3. The case of the prosecution is that on 26.11.2024 the informant was returning from his work and as he reached near Patwaha five persons surrounded him. This petitioner has been named as younger son of Phulen. It is further alleged that as he reached near the house of Manish Yadav certain persons have made ambush there. It is alleged that they demanded rangdari and assaulted him.
4. Learned counsel appearing on behalf of the petitioner
Patna High Court CR. MISC. No.31601 of 2025(2) dt.16-05-2025 2/2 has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. It has further been submitted that name of this petitioner has surfaced only in the first part of the occurrence. There is no role of this petitioner in the second part. No specific overt act has been alleged against the petitioner. It has also been submitted that petitioner is a student of Lifeline Diagnostics & Research Inst. Gangjala, Saharsa and his examination is scheduled on 24.05.2025. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. He is languishing in judicial custody since 02.03.2025.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa in connection with Baijnathpur P.S.
