Petitioner is accused in connection with Sessions Trial No. 708 of 2019 arising out of Jagdishpur P.S. Case No. 70 of 2019 registered under Sections 341, 323, 504, 307, 34 of the I.P.C. and later on, section 302 of the Indian Penal Code has been added.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in this case. On perusal of first information report, it appears that the alleged application has been written by the informant-deceased and signed by Binod Kumar, who is father of the deceased. The contents of the first information report clearly indicate that the

No.30705 of 2020(4) dt.10-03-2021 2/2 informant himself filed written application before the police, but in the last portion of the written application of the informant, two persons made signature, which creates doubt about the genuineness of the allegation as alleged. It is also submitted that petitioner is in custody since 21.07.2019.

Having considered the above facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-IV, Bhagalpur in connection with Sessions Trial No. 708 of 2019 arising out of Jagdishpur P.S. Case No. 70 of 2019.
