The petitioner apprehends his arrest in connection with Special (Excise) Case No. 220 of 2020 arising out of Excise Department Case No. 50 of 2020 registered under sections 30(a) of the Bihar Prohibition and Excise Act pending in the Court of Special Judge, Excise Act, Saharsa. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case.
Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that there is involvement of the petitioner in the trade of illicit liquor and the
Patna High Court CR. MISC. No.31093 of 2020(2) dt.10-03-2021 2/2 recovered illicit liquor belongs to this petitioner. Hence, the petitioner does not deserve to be enlarged on anticipatory bail. Having considered the above facts and circumstances of the case, this Court is not inclined to allow the prayer of the petitioner. Accordingly, prayer for grant of anticipatory bail of the petitioner is rejected.
