1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 342, 323, 324, 447, 448 read with section 34 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and have been falsely implicated in the instant case by the informant. It is next submitted that even presuming what has been alleged is true without admitting then the allegation of assaulting the wife of the informant is against Lakshman Thakur. It is next submitted
Patna High Court CR. MISC. No.36213 of 2024(2) dt.19-06-2024 2/2 that similarly situated co-accused have been granted the privilege of anticipatory bail by a learned co-ordinate Bench of this Court by an order dated 30.05.2024 in Cr. Misc. No.34955/2024. It is next submitted that the case of the petitioners are also on similar footing, as such, based on parity, seeks anticipatory bail.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
5. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Purnahya P.S. Case No.153/2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
