2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 384, 386, 504, 506 and 34 of the Indian Penal Code.
3. The case of the prosecution is that a call was made from the mobile number of this petitioner to the informant for rangdari of Rs. 1,00,000/-. It is further alleged that the clerk of the informant has paid Rs. 25,000/- each to certain persons whose names are described in the FIR. The informant has also alleged that he has come to know that certain persons named in FIR had made a group with fake MCC name and they are collecting rangdari from the local businessmen.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.31503 of 2025(2) dt.15-05-2025 2/3 petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel for the petitioner has submitted that though the call from which SIM was made is in his name but the real fact is that he is a labourer and his bag was stolen in the year 2017 which contained his aadhaar card and other documents also. He has also submitted that he has never used the said mobile number. Learned counsel for the petitioner has also submitted that co-accused persons having graver nature of the allegations have been granted bail by learned Co-ordinate Bench vide order dated 29.03.2018 in Cr. Misc. No. 17298 of 2018 and vide order dated 12.12.2018 in Cr. Misc. No. 62546 of 2018. The case of this petitioner stands on better footing. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 05.04.2025.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with
Patna High Court CR. MISC. No.31503 of 2025(2) dt.15-05-2025 3/3 Sheohar P.S. Case No. 201 of 2017 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sheohar. (Ashok Kumar Pandey, J) Shubham/- U T
