The petitioner seeks bail in a case registered under Sections 341, 323, 307, 120B/34of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case, in short, is that one Chandan Kumar who happened to be the informant of instant case, lodged the aforesaid FIR alleging therein that on 25-02-2020 when he was sitting at his shop, the petitioners came there and asked him to come with them and thereafter, they forcibly took him with their Motorcycle, but anyhow the informant started fleeing, then the petitioner shot fire upon him and thereafter, getting injury he was admitted to the Hospital. It has been submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.30961 of 2020(3) dt.08-01-2021 2/2 the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 15-04-2020. Charge sheet in this case has already been submitted. The petitioner has been falsely implicated in the present case. The allegation of firing upon the victim is denied by the petitioner. It has further been submitted that the petitioner may be released after completion of one year in custody.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that after completion of one year in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Danapur in connection with Paliganj P.S. Case No. 81 of 2020.
