2. The petitioners are apprehending their arrest in Chapra Muffasil P.S. Case No. 52 of 2023 registered under Section 341, 323, 324, 325, 307, 379, 504/34 of the IPC.

3. The specific allegation against petitioner no. 1 is of assaulting the informant with dab on his head. Similarly, the specific allegation against petitioner no. 2 is of assaulting the informant's wife on her head.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in the present case. They are persons of clean antecedents. Learned

Patna High Court CR. MISC. No.33221 of 2025(5) dt.23-12-2025 2/2 counsel has further submitted that the injuries inflicted upon the injured persons are found to be simple in nature. It has further been submitted that prior to the present case, mother of the petitioner no. 1 has lodged Chapra Muffasil P.S. Case No. 45 of 2023 against members of prosecution side on 19.01.2023 and in retaliation, they have lodged the present case.

5. On the other hand, learned APP for the State opposed the prayer for anticipatory bail of the petitioners.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 52 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of the BNSS, 2023.
