JUSTICE PARTHA SARTHY ORAL ORDER 02-02-2021 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Excise Case no.10 of 2014 registered under section 47(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the F.I.R., 80 litres of country liquor is stated to have been recovered from the road side and it is stated that the petitioner managed to escape. It is submitted by learned counsel for the petitioner that the allegation against the petitioner of having escaped is false and incorrect. In any case, the place of recovery is the road side. No recovery has taken place from the person or possession

Patna High Court CR. MISC. No.32596 of 2020(2) dt.02-02-2021 2/2 of the petitioner. The petitioner is in custody since 20.3.2020. Charge sheet has been submitted in the case.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the petitioner being in custody since 20.3.2020 and the place of recovery, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Excise Case no.10 of 2014 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II-cum-Special Judge, Excise Act, Samastipur.
