The petitioner is apprehending arrest in connection with Nawada Town P.S. Case No. 423 of 2018 for offences under Sections 420, 406, 379, 120(B) of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. The petitioner is the owner of the truck which was used for the purpose of transportation. The allegation is that the truck was used for movement of Mung valued at Rs. 10/- lacs and odd but instead of reaching the destination the Mung loaded on the truck was unloaded at different place.
Patna High Court Cr.Misc. No.62591 of 2018(2) dt.17-12-2018 2/2 Learned counsel for the petitioner further submits that the petitioner has no knowledge about the lifting of the Mung and instead of unloading it at the destination it was unloaded at some different place.
Considering the fact that the petitioner is a lady and has no criminal antecedent, the court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 423 of 2018 , subject to the conditions as laid down under Section 438(2) Cr. P. C. In the event the truck of the petitioner is found indulged in such activities in future, the court below shall cancel the bail bonds of the petitioner.
