Mr.Prabhat Ranjan Singh (Aag15) ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-08-2019 Grievance of the petitioner in the present writ application is pick and choose in the matter of grant of trained pay scale.

Learned counsel for the petitioner would submit that the petitioner was initially appointed as Shiksha Mitra on 27.3.2003. Later on, the petitioner was absorbed as Panchayat Shikshak.

Learned counsel submits that in similar fact situation one Anila Kumari appointed on 20.2.2003 has been granted

Patna High Court CWJC No.9526 of 2019(3) dt.27-08-2019 2/2 trained scale vide memo no. 161 dated 21.12.2008 but petitioner was meted step motherly treatment and despite fulfilling all the conditions for grant of trained scale the petitioner has been denied trained scale.

In view of the above, the writ petition is disposed of with a direction to the District Programme Officer (Establishment), Patna to take appropriate decision with regard to claim of the petitioner for grant of trained scale on the line of benefit was extended to Anila Kumari.

In the event, the case of the petitioner is found similar to that of Anila Kumari the petitioner should be granted similar treatmentand if Anila Kumar has been granted the benefit of trained scale erroneously, the respondents may take corrective meas after opportunity of hearing to Anila Kumari. Necessary corrective measure with regard to grant of trained scale to the petitioner may be taken by the respondent within a period of three months from the date of receipt/production of a copy of this order.

With the aforesaid, the writ application stands disposed of.
