2. The present application has been filed for modification of the order dated 27.11.2025 passed in Cr. Misc. No. 81064 of 2025 by which the petitioner was granted bail in connection with Mahua P.S. Case No. 976 of 2025 to the satisfaction of Court below/concerned Court with certain conditions.
3. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.32965 of 2026(2) dt.08-05-2026 2/3 order dated 27.11.2025 passed in Cr. Misc. No. 81064 of 2025, petitioner along with other co-accused, Sarbjeet Singh was granted bail by this Court with certain conditions and one of those conditions being that one of the bailors shall be own/close member of the family of the petitioner. Learned counsel for the petitioner submits that mother and father of the petitioner has already died and there is no brother or sister of the petitioner and the petitioner is the sole member in his family. Learned counsel submits that due to non-availability of the close relative, bail bonds of the petitioner could not be furnished. Learned counsel, therefore, prays that the said condition may be modified accordingly.

Considering the submissions advanced on behalf of the learned counsel for the petitioner and the grounds mentioned in the present modification application, this Court finds sufficient cause for modification of the condition imposed vide order dated 27.11.2025 passed in Cr. Misc. No. 81064 of 2025.
5. Accordingly, the order dated 27.11.2025 passed in Cr. Misc. No. 81064 of 2025 is modified to the extent that the condition requiring one of the bailors to be an own/close family member of the petitioner is hereby waived. The rest part of the said order shall remain intact.

6. The modification application is, accordingly, allowed.
