JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Sikty (Bardaha) P. S. Case No. 48 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 354-B and 379 of the Indian Penal Code.

The petitioners are said to have assaulted Mamta Devi, Beena Devi and Raja Kumar Sah but submission on behalf of the petitioners is that the aforesaid persons did not sustain any injury and so far as the injured persons of this case are concerned, they have sustained simple injury which is evident from perusal of Annexure 3 series to this petition.

No.61288 of 2018 (2) dt.08-10-2018 2/2 Regard being had to the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri S.K. Sharma, learned Judicial Magistrate 1st Class, Araria/concerned court in Sikty (Bardaha) P. S. Case No. 48 of 2018 subject to conditions as laid down under Section 438(2) of the Cr. P. C.
