This application for anticipatory bail arises out of Khaira P.S. Case No. 330 of 2018, disclosing offences under Sections 341, 323, 384, 504 and 506/34 of the Indian Penal Code, including Section 17 of the C.L.A. Act. It appears from the records that the parties are on litigating terms.
It is alleged in the complaint petition, which is the basis for registration of the present FIR that the accused persons
Patna High Court CR. MISC. No.30196 of 2019(2) dt.08-05-2019 2/3 were demanding extortion and they are said to have snatched certain cash from the complainant on 13.09.2018, for which a complaint petition was filed on 18.09.2018.
It is stated by the learned counsel for the petitioners that prior to filing of the present case, an FIR was registered on 06.08.2018 by the uncle of petitioner no.1, based on a complaint case, which is the reason why the complaint case has been filed, in retaliation.
Considering the facts and circumstances of the case, this application is allowed. Let the petitioners, above named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned Additional Chief Judicial Magistrate, 10th, Saran at Chapra, in connection with Khaira P.S. Case No. 330 of 2018, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions,
