2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 191(2), 191(3), 190, 326(b), 308(5), 352, 351(2), 351(3) and 115(2) of the B.N.S.S.

3. The case of the prosecution is that informant left from his house to the shop and reached near Milki Mohalla near the house of Dr. Anwar. Six persons came out from the street and started beating the informant. Out of them one was Belal Miya and the other was the petitioner along with Ganesh Kumar and three unknown persons who have masked their face. They were also using filthy words. It is further alleged that Belal Miya took Rs.1,30,000/- from his pocket and got down the informant from the bike and attempted to take him away towards the street.

4. Learned counsel for the petitioner submits that there

Patna High Court CR. MISC. No.31549 of 2025(2) dt.15-05-2025 2/2 is only allegation against the petitioner is that he has assaulted. From the perusal of the FIR itself it is not clear as to what was the weapon of assault. From perusal of impugned order it transpires that the nature of injury is kept reserved till on X-ray & NCCT report comes. There is no specific allegation against the petitioner as to on which part of the body he has assaulted. The petitioner is having criminal antecedent of one case in which he is on bail. The petitioner is in custody since 24.01.2025.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Ara Nagar P.S. Case No. 783 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara.
