JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 28.09.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Sahpur P. S. case no. 127/2018 registered under sections 341, 323, 324, 307 and 379/34 of the IPC.
The petitioner is said to have given rod blow to the informant's son namely, Santosh Kumar causing injury on his head but annexure 3 to the petition goes to show that only abrasion was found on the person of injured Santosh Kumar and no injury on the head of the informant's son was found. Moreover, all injuries are found simple in nature caused by hard and blunt substance.
Considering the aforesaid facts and circumstances
Patna High Court Cr.Misc. No.59336 of 2018 (2) dt.28-09-2018 as well as submissions of the parties, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-14, Bhojpur at Ara in Sahpur P. S. case no. 127/2018 subject to condition as laid down under section 438(2) of the Cr.P.C.
