====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 08-02-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 325, 307, 504, 506 and 447 of the Indian Penal Code.
Petitioner allegedly caused injury with farsa in his hand, at the head of the informant. Others also caused injury. The Doctor has found incised wound at the head of the informant. There is case and counter case between the parties. Learned counsel for the petitioner submits that the petitioner was not sent up for trial as some of the witnesses stated before the police that the petitioner was not there at the time of occurrence. Petitioner has got no criminal antecedent. Considering the nature of allegation against the

No.31044 of 2020(3) dt.08-02-2021 2/2 petitioner and the fact that he has knowledge that his act might cause death, I am not inclined to enlarge the petitioner on anticipatory bail in connection with Amnour P.S. Case No. 153 of 2014 pending in the court of learned Additional Chief Judicial Magistrate-II, Saran at Chapra.
Hence, prayer of the petitioner for grant of anticipatory bail is refused.
Petitioner is directed to surrender and pray for regular bail which shall be disposed of on its own merit and without being prejudiced by this order.
