JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-01-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner no. 1 husband whereas petitioner no. 2 is father-in-law of the deceased.

Admittedly, the informant is not an eye witness of the alleged occurrence and he lodged the present case on the basis of information gathered from others as well as previous conduct of the petitioners.

In course of investigation, several witnesses stated that deceased committed suicide and accordingly, police submitted charge sheet for the offence punishable under Section 306 and 201 of the Indian Penal Code. Learned counsel for the petitioners

Patna High Court Cr.Misc. No.25975 of 2014 (4) dt.09-01-2015 2/2 submits that as a matter of fact, deceased died of her natural death but informant in collusion of enemies of the petitioners lodged this case but subsequently, when informant realized his fault he entered into compromise.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Jhanjharpur in connection with Madhepur P.S.Case No. 92 of 2013, G.R No. 667 of 2013.
