Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is alleged to have fired from his

Patna High Court CR. MISC. No.31205 of 2020(4) dt.27-10-2021 2/2 pistol on the son of the informant who died at the spot. It is submitted by learned counsel for the petitioner that petitioner and the informant are agnates and in the background of land dispute between the parties, the petitioner has been implicated in this case. Moreover, for the alleged occurrence of 05.04.2019 at 4:00 P.M., the F.I.R has been registered on 06.04.2019 at 10:30 A.M. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the fact that there is direct allegation of firing against the petitioner due to which the son of the informant succumbed to the injuries, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

The application stands dismissed.
