2. This is second anticipatory bail petition. Earlier, the petition, filed for grant of anticipatory bail on behalf of petitioner, stood rejected, vide order dated 07.08.2023 passed in Cr. Misc. No. 38032 of 2023.
3. Petitioner apprehends arrest in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.
4. By filing this pre-arrest bail application, learned counsel for the petitioner seeks parity with other co-accused persons and submits that similarly situated co-accused, namely, Sandeep Kumar @ Sandeep Kumar Singh and co-accused,
Patna High Court CR. MISC. No.34416 of 2024(2) dt.05-07-2024 2/2 namely, Sanjit Kumar have already been granted anticipatory bail by co-ordinate Benches of this Hon'ble Court vide order dated 12.02.2024 passed in Cr. Misc. No. 41139 of 2023 (Annexure-P/3) and order dated 02.02.2023 passed in Cr. Misc. No. 71871 of 2022 (Annexure-P/4) respectively.

On the ground of parity, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Patna in connection with Gardanibagh P. S. Case No. 124 of 2003, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
