The petitioner is the widow of a work-charged
Patna High Court CWJC No.7577 of 2017(5) dt.20-05-2020 2/3 employee, who died before his service could be regularized.
The learned counsel for the petitioner submits that by virtue of the Full Bench judgement of this Court in the case of Mobina Khatoon Vrs. The State of Bihar & Ors., reported in 2019 (1) PLJR 1015 and the sequel decision of the Government of Bihar, the petitioner is entitled to be paid the family pension as her husband had worked for more than 10 years on regular basis in a work-charged establishment.
Mr. Arvind Ujjwal, learned counsel for the State has submitted that in case a representation is made on behalf of the petitioner before the concerned respondent within a period of eight weeks, the same shall be looked into, the facts shall be verified and a reasoned order shall be passed within a further period of eight weeks thereafter. If the claim of the petitioner is found to be tenable and in accordance with law, necessary sequel order shall also be passed within the aforesaid period.
