====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 19-01-2021 Heard learned counsel for the petitioners and learned counsel for the State.

This application has been filed for modification of order dated 15.07.2020 passed in Cr. Misc. No. 17262 of 2020 for extension of time for surrender in the learned court below. Learned counsel for the petitioners submits that the petitioners have been granted anticipatory bail in connection with Mahila P.S. Case No. 10 of 2018 and were directed to surrender within four weeks before the learned court below from the date of order i.e. 15.07.2020 for submitting the bail bonds but the same was not properly informed by the Karpardaj of the case of the petitioners

Patna High Court CR. MISC. No.3614 of 2021(2) dt.19-01-2021 2/2 because the court was closed due to COVID-19 Pandemic. Learned A.P.P. for the State has no objection in extension of time for surrender and submitting the bail bonds in the court below.

Having regard to the facts and circumstances of the case stated in the modification application wherein it has been submitted that the petitioners were not properly informed by the Karpardaj of the case about the order of this Court and further submission that the court was closed due to COVID-19 Pandemic and all these factors led to expiry of the period fixed in the order passed by this Court on 15.07.2020 in Cr. Misc. No. 17262 of 2020, this Court, in the interest of justice modifies the operative part of the order dated 15.07.2020 passed in Cr. Misc. No. 17262 of 2020 to the extent that four weeks time granted to the petitioners to surrender and submit their bail bonds shall be reckoned with from today.

If the petitioners surrender in the learned court below within four weeks from today their bail bonds shall be accepted after being satisfied with the compliance as regards the bail bonds indicated in the order dated 15.07.2020 passed in Cr. Misc. No. 17262 of 2020. Rest of the order shall remain intact. This application stands disposed of accordingly.
