JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 31-10-2018 The petitioner has filed this application for modification of order dated 17.10.2017 passed by this Court with the prayer that at least four weeks' time after Chatth Puja holidays be granted to him to comply the order dated 17.10.2017 as he yet could not manage the money to be furnished to the informant. Learned counsel for the informant opposed the aforesaid prayer of the petitioner submitting that he has already been given sufficient time for payment of the money but he is intentionally avoiding the same hence his bail bond may be cancelled. From perusal of the record, it appears that earlier vide order dated 17.10.2017 petitioner was directed to make payment of Rs. 1,75,000/- to the informant and vide order dated 02.05.2018 the aforesaid order was modified and four months' more time was

Patna High Court Cr.Misc. No.58887 of 2018 (2) dt.31-10-2018 2 / 2 given to the petitioner by way of last indulgence for compliance of the aforesaid order but in vain.

However, in the facts and circumstances of the case and in the interest of justice, petitioner is directed to make payment of the aforesaid amount to the informant by 10th of December, 2018 positively without fail.
