1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and allegation is of recovery of 69.84 litres of liquor from an E-rickshaw.
4. Learned counsel for the petitioner submits that petitioner came to be arrested on the ground that he is owner of the seized vehicle. It is further submitted that no prudent person would use his own vehicle for committing an occurrence and, thus, would create evidence against himself and, hence, would get implicated. It is next submitted that petitioner was completely unaware that passenger would misuse the vehicle in
Patna High Court CR. MISC. No.33577 of 2026(2) dt.15-05-2026 2/2 the manner as alleged who also fled from the spot. It is also submitted that petitioner is in custody since 18.10.2025.
5. Learned A.P.P. for the State opposes the prayer for regular bail of the petitioner.
6. Considering the submissions made by the learned counsel appearing on behalf of the petitioner, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs.5,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending in connection with Garkha P.S. Case No. 774 of 2025.
