Heard the parties.

The petitioner is languishing in custody for the offence punishable under Section 392 of the Indian Penal Code. The F.I.R. of the occurrence of robbery is against unknown. Petitioner is in custody since 03.01.2020. Submission is that nothing incriminating was recovered from the possession of the petitioner nor the petitioner was put on T.I. parade.

The impugned order reveals that a mobile phone and eight live cartridges were recovered from the possession of the

Patna High Court CR. MISC. No.31144 of 2020(2) dt.08-12-2020 2/2 petitioner. Recovered mobile was a looted mobile. Petitioner has got criminal antecedent. Petitioner was remanded in this case from other case.

Considering the period already undergone by the petitioner and nature of material as well as completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Chhauradano P.S. Case No. 393 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
