Petitioners seek bail in a case registered for the offence punishable under Section 37C of the Bihar Prohibition and Excise Act and section 307 and other allied sections of the Indian Penal Code.

As per the prosecution case, petitioners and other accused persons in drunken state, armed with deadly weapons, attacked the house of the informant and when police reached there, accused persons tried to snatch the arms of the police

Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. There is general and omnibus allegation against all the accused persons and no specific overt act has been alleged against them. Injuries caused by the petitioners have been found to be simple in nature. They are in custody since 6.4.2021. Investigation is complete.

Considering the facts of the case, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II cum Special Judge, Excise Act, Samastipur in Patori Mohanpur OP Police Station Case No. 47 of 2021.
