Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 302 and 307/34 of the Indian Penal Code as well as Section 27 of the Arms Act, registered in connection with Barahiya P.S.Case No. 67 of 2006. As per allegation, seven accused persons named in the FIR including the present petitioner forcibly took away Navin Singh, the son of the informant and on the order of coaccused Ramakant Singh, co-accused Vikash Kumar murdered

Patna High Court CR. MISC. No.45370 of 2021(2) dt.13-04-2022 2/2 him by firing shot by his SLR. Co-accused Gautam Kumar and Nunu Babu also fired shot on the deceased.

The learned counsel for the petitioner has submitted that the petitioner is not the assailant nor the order-giver. The allegation against the petitioner is that he along with other accused persons dragged away the deceased and coaccused Gautam Kumar and Nunu Babu fired shot at him. In my view, it is not a fit case for anticipatory bail. The prayer on behalf of the petitioner for anticipatory bail is hereby rejected.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
