2. The petitioner is apprehending his arrest in connection with Baishi P.S. Case No. 238 of 2019, F.I.R. dated 05.10.2019 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 30(A), 33, 41, 47 of the Bihar Prohibition and Excise Act.
3. The case relates to recovery of 16000 (sixteen thousand) litres of raw spirit.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not
Patna High Court CR. MISC. No.30746 of 2026(2) dt.01-07-2026 2/2 committed any offence as alleged in the F.I.R and the name of the petitioner has been transpired on the basis of disclosure made by apprehended co-accused person.
5. Learned APP for the State, on the other hand, opposed the prayer for anticipatory bail of the petitioner and submits that from perusal of the paragraph-3 of the bail petition which suggests that the petitioner is involved in ten cases of similar nature other than the present one.
6. Considering the aforesaid facts and circumstances of the case, this is not a fit case for grant of anticipatory bail and hence, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Baishi P.S. Case No. 238 of 2019 pending in the Court of learned Exclusive Special Judge, Excise Court No. 1, Purnea.
7. Prayer is refused.
