2. The petitioner seeks bail in a case registered for offence under Sections 302, 328, 201, 120(B) of the Indian Penal Code.
3. As per prosecution case, daughter of the informant was married with one Sunil Pal, who is younger brother of this petitioner, and out of the wedlock, two sons were born. Some dispute was going on for partition of property and on 18.08.2019, one of the member from the petitioner's side informed the informant that his daughter has been admitted to hospital due to illness and she is not in good condition. On receipt of such information, when the informant went to his daughter's matrimonial home, he came to know that his daughter
Patna High Court CR. MISC. No.34494 of 2024(2) dt.12-07-2024 2/3 has died. It is further alleged in the F.I.R. that after assaulting, the deceased and one of her son had been administered poison leading to their death.
4. Learned counsel for the petitioner submits that petitioner is Bhaisur of the deceased. As a matter of fact, there was a private dispute between the husband and wife and deceased (wife) consumed poison and also administered poison to her son and in retaliation, this false and concocted case has been lodged by the informant. He further submits that postmortem report does not indicate any external injury on the person of the deceased. The opinion regarding the cause of death could not be ascertained as viscera was sent for chemical examination and the report is still awaited. Some of the other similarly situated persons have already been granted bail by this Court. Petitioner is in custody since 21.06.2023, having no criminal antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
