29-10-2021 Heard learned counsel for the parties through video conferencing.
The petitioner seeks bail in Minapur P.S. Case No. 378 of 2020, G.R. No. 4090 of 2020, registered for the offence under Section 461, 379 of the Indian Penal Code. As per the prosecution case, some unknown miscreants committed theft of mobile phone worth Rupees Ten lacs and cash of Rupees Fifty thousand from the shop of the informant.
Petitioner is not named in the FIR. Name of the petitioner has transpired during course of investigation in the confessional statement of co-accused Prem Kumar, who has already been granted bail by the court below itself. No looted article has been recovered from the conscious possession of the
Patna High Court CR. MISC. No.42937 of 2021(2) dt.29-10-2021 2/2 petitioner and he is in custody since 05.12.2020. Chargesheet has already been submitted.
Learned A.P.P. for the State has opposed the bail petition.
Considering the period of custody and the fact that no looted article has been recovered from the possession of the petitioner, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Muzaffarpur in connection with Minapur P.S. Case No. 378 of 2020.
