JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2021 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 23.5.2020 in connection with Audhaura P.S. Case No. 19 of 2008 registered for the offences punishable under Sections 3 / 4 of Explisive Substance Act and Section 17 of C.L.A. Act.

The name of this petitioner came in this case in the confessional statement of co-accused Sikandar Uraon and Ram Pravesh Uraon. Admittedly, neither petitioner was caught on the spot nor anything was recovered from his conscious possession. Learned counsel of the petitioner submits that petitioner was in custody in connection with another case and remained in jail custody for near about 12 years. No doubt, petitioner does have criminal antecedents but considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Adhaura P.S.
