1. The present writ petition has been filed seeking the following relief(s):- "1. That this is an application for issuance of the writ in the nature of certiorari or any other writ / writs, order / orders. direction / directions commanding upon the respondents authority to execute the order of the Circle Officer, Bhabua and to remove the Encroachment from public land Road over the Khata No.147 Plot No.469 Mauza Khanethi Horilpur Thana No.567 Area 1.03 decimals situated at village Khanethi Horilpur, P.S.- Sonhan, District Kaimur by one Purnwashi

Patna High Court CWJC No.3265 of 2013(8) dt.19-06-2024 2/2 Ram Ramchandra Ram, Ramdas Ram, Ramdhani Ram, Bidesi Ram, Chandra Ram and others at village Khanethi, P.S.- Sonhan, District- Kaimur and to quash the order dated 13.3.2012 in Encroachment case no.3/2010-11 passed by the Circle Officer. Bhabua."

At the outset, the learned counsel for the petitioner submits that in view of the statement made in the counter affidavit, filed by the respondent-State to the effect that the road in question has already been constructed under the Pradhan Mantri Gram Sadak Yojna and the vehicles are running on the same, the petitioner be granted liberty to agitate his subsisting grievances, if any, in accordance with law. Liberty so sought is granted.
