This application for anticipatory bail arises out of Bhagwanpur (Belaon) P.S. Case No. 59 of 2020, disclosing the offence under Sections 341, 323, 307, 379, 504, 506, 34 of the Indian Penal Code.

Petitioners no. 2 and 3 are sons of petitioner no. 1. Allegedly, they started abusing the informant and assaulting him with lathi and axe. It is alleged against petitioner no. 2 that he snatched a golden chain of the informant.

Learned counsel appearing on behalf of the petitioners has submitted that in respect of the same occurrence

Patna High Court CR. MISC. No.30804 of 2020(2) dt.08-01-2021 2/2 a counter-case has been registered as Bhagwanpur P.S. Case No. 64 of 2020. He has submitted that the injuries have so far been found to be simple in nature.

Considering the circumstance in which the occurrence is said to have taken place as has been described in the FIR, this application is allowed. Let the petitioners, abovenamed, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua, in Bhagwanpur (Belaon) P.S. Case No. 59 of 2020, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the Police/ Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
