2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 272 and 273/34 of the Indian Penal Code and section 30a of the Bihar Prohibition and Excise Act.

3. Prosecution case is that 6400 liters spirit was recovered from a truck of which petitioner is the owner.

4. Learned counsel appearing for the petitioner submits that the truck in question was registered for commercial purpose and petitioner was not aware of the nature of consignment being transported from his truck. Petitioner claims clean antecedent. He is in custody since 22.2.2024.

5. Considering the aforesaid facts of the case, this regular bail petition is allowed. Let these petitioners, above

No.37389 of 2024(2) dt.05-07-2024 2/2 named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Exclusive Special Excise Court No. I, Civil Court, Motihari, East Champaran in Kotwa Police Station Case No. 320 of 2020.
