JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-12-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 379, 328/34 of the Indian Penal Code.
As per the prosecution case, two unknown miscreants looted informant's e-rickshaw, cash Rs.700/- and mobile phone.
Learned counsel for the petitioner submits that allegation against the petitioner is that the stolen mobile phone of the informant has been recovered from the possession of the petitioner to which he submits that as per material collected during investigation and contained in paragraph 62 of the case diary, the International Mobile Equipment Identity (IMEI) number of the mobile phone of the informant does not tally
Patna High Court CR. MISC. No.41711 of 2021(4) dt.13-12-2021 2/2 with the IMEI of the mobile phone which is said to have been recovered from the possession of the petitioner. Petitioner claimed clean antecedent and he is in custody since 1.3.2021. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge VIII, Muzaffarpur in Kudhani Police Station Case No. 94 of 2021.
